Where To Find Information About Enforcement
The New Jersey Child Support system utilizes many enforcement remedies to enforce child support orders. Information about these actions can be found by visiting our website, www.njchildsupport.org, navigating to either the “Custodial Parents” or “Non-Custodial Parents” tab and selecting the “Enforcement: Making Sure Child Support Gets Paid” link.

Enforcement of Alimony Only Cases
Your case is open for the collection of spousal or alimony support only. Many of the enforcement actions made available by Title IV-D of the Social Security Act are only available to those cases with active child support obligations or arrears owed to child support. As a result, efforts by the probation division to enforce your obligation are restricted to the sending of delinquency notices and the scheduling of Enforcement of Litigant’s Rights hearing, when appropriate. To request further action, you will need to petition the family court of venue by filing a motion.

How to file for an Appeal
If you disagree with a judge’s ruling, there are two (2) avenues of appeal available to you. Within 20 days, you may file a motion requesting reconsideration. Following the 20 days but no longer than 45 days, you may file a written appeal to the Appellate Division at P.O. Box 006, Trenton, NJ 08625. If the 20 and 45 day thresholds have elapsed, you may wish to file a new motion regarding your concerns. For more information, you can call the Appellate Division at 609-292-4822.

How to Cancel My Direct Deposit
You must notify the New Jersey Family Support Payment Center (NJFSPC) by sending a letter to the address listed below. Direct deposit will stop within five business days from the date the NJFSPC receives your request. 1. Credit Reporting
Child support debt will take precedence in any attempt he/she makes to obtain a loan or any type of credit.
2. Federal Tax Offset Program and New Jersey’s Set-Off Individual Liability Program
Under the terms of these programs, should the non-custodial parent file state and/or federal taxes, and is entitled to an income tax refund, this money will be intercepted and applied to the arrears balance.
3. The Financial Institution Data Match Program also known as a Bank Levy
Facilitates the collection of child support arrears owed. The case is selected for a bank levy if specific case criteria are met, and if the non-custodial parent has sufficient funds in the bank, or has other liquid assets, the child support office may be able to acquire these assets to pay the arrearages. *FIDM Criteria: This is for internal staff guidance* Review the criteria below, then review the case to let the customer know if the case qualifies or not. 1. Current Charging Cases: MSO + arrears payback not satisfied for previous 2 months and the arrears are greater than 3 times MSO. 2. Arrears Only Cases: Arrears-are greater than $500, and arrears payback not satisfied for previous 2 months.
4. Child Support Lien Network
If the non-custodial parent qualifies, insurance settlements can be intercepted and applied to the child support arrearages.
5. Judgment
A judgment is automatically entered by operation of law on the day that a balance of $25 or greater accrued in arrears. When the judgment was entered, it places a statewide lien on any real property in NJ that is owned by the non-custodial parent. A child support judgment must be satisfied in order for the non-custodial parent to sell real estate property or modify a mortgage loan.

1st Check over $1,000 Hold Explanation
To ensure that funds are able to be distributed, the first check received in excess of $1,000 is put on a courtesy hold for ten business days. After the payment is released, any further payments of $1,000 or greater will be processed within 48 hours and applied to the case, per federal guidelines.

How to speak to a live rep at the NJFSSC
Once you enter your Member ID and Pin number you will be provided with a list of prompts. Select “Payments”. Afterwards, you will be given a second list of prompts. If you do not make a selection the prompts will be provided again, this time the last option will be to speak with a representative.

Non IV-D Child Support Case

Passport Denial Info
A passport application or request for renewal can be denied if the arrears owed are greater than or equal to $2,500 at any time. New Jersey has a zero balance arrears policy which means that, generally, the arrears must be paid in full before the passport is able to be restored. Can CS continue beyond the child’s 23rd birthday?
Effective December 1, 2020, the law was amended to allow for the continuation of support beyond the age of 23 if the child has a severe mental or physical incapacity that causes the child to be financially dependent on a parent.
Questions about Termination Age
New Jersey law dictates age 19 as when a child support and/or medical support obligation will end. The law allows for child and/or medical support to continue up to age 23 for cases in which the dependent is still in high school; attending full-time college, vocational or graduate school; is disabled; if the parties reached a separate agreement; or, if continued support was granted by the court. Appeal

What Is a Triennial Review?
A Triennial Review allows either party on the case to request a review of the child support order every three years. The review is based on the income of both parties, the New Jersey Child Support Guidelines and whether there is a 20% change between the current and new award amount. To have this review done, you must complete the form and return it. The notice provides detailed instructions on how to complete the form.

Wage Garnishment Limitations
The Consumer Credit Protection Act limits the amount that may be withheld from an individual’s source of income to 65% for any reason, including child support. This means that the income source cannot deduct more than 65%, even if the child support exceeds this amount.
